COOKIES POLICY

The RPTE wishes to provide users with information about the use of cookies on its websites.

Cookies are files that may be downloaded onto a device through web pages. They are tools which play an essential role in the provision of many different information society services. Among other roles, they enable a website to store and recover information about the browsing habits of a user or of that user’s device and, depending on the information obtained, they may be used to recognise the user and to improve the level of service provided.

Types of cookies

We can make a distinction between two types of cookies, depending on the organisation that manages the domain from which the cookies are sent and that processes the data that are obtained: own cookies and third-party cookies.

We can also make a distinction between session cookies or permanent cookieswhen considering the period of time that these remain stored in the client’s browser.

Lastly, there is a further classification which distinguishes five different types of cookies depending on the purpose for which data obtained are processed: technical cookies, personalisation cookies, analytics cookies, marketing cookies and behavioural marketing cookies.

Cookies used for any of the following purposes are not required to comply with the obligations outlined in Article 22.2 of Law 34/2002 of 11 July governing information society services and electronic commerce (hereafter referred to as the LSSI):

– Merely enabling communication between the user’s device and the network

– Strictly providing a service which has been expressly requested by the user

In this regard, the Article 29 Working Party in Ruling 4/2012 (Ruling 4/2012 regarding exemption from the requirement for consent for cookies, http://ec.europa.eu/justice/data-protection/article-29/documentation/opinion-recommendation/files/2012/wp194_es.pdf) has ruled that exempted cookies include those that serve the following purposes:

– «User access» cookies

– Cookies for the authentication or identification of users (session only)

– User security cookies

– Media player session cookies

– Load balance session cookies

– User interface personalisation cookies

– Complementary (plug-in) cookies for the exchange of social content

It can therefore be understood that these cookies remain exempted from the scope of the application of Article 22.2 of the LSSI and that for the same reason it shall not be necessary to provide information about, nor obtain consent for, their usage.
